Public Offer Agreement for the Provision of Services

PLEASE READ THIS AGREEMENT BEFORE PROCEEDING WITH THE PAYMENT PROCEDURE

1. General Provisions

1.1. This document is an official offer for the conclusion of a contract for the provision of a one-time Service (public offer) by an individual Rachid Nougmanov, hereinafter referred to as the "Contractor", and contains all the essential conditions for the provision of the Service to any legal entity or individual referred to in hereinafter referred to as the "Customer".

1.2. In accordance with Article 396 of the Civil Code of the Republic of Kazakhstan, if the person who received the offer performs actions to fulfill the terms of the contract specified therein (in particular, payment for the Service), the actions are considered to be the acceptance of the offer. In this case, the contract is deemed to be concluded without signing in each specific case, since the acceptance of the offer is equivalent to the conclusion of the agreement on the terms and conditions specified below.

1.3. Acceptance of this Offer Agreement is the Customer's payment for the selected Service.

1.4. By accepting this Public Offer Agreement, the Customer confirms their legality, powers, legal capacity, age of 18, and the legal right, not specified above, to enter into contractual relations with the Contractor.

2. Subject of the Offer

2.1. The Contractor undertakes, on the instructions of the Customer, to provide the latter with the Service for the provision of an online consulting course on storytelling, and the Customer undertakes to pay for this Service under the terms of this Offer.

2.2. The full description of the Service, its subjects, content, time, terms, and procedure is posted on the Contractor's official website at https://dramaticon.com/course.

3. Procedure for the provision of the Service

3.1. The Contractor provides the Customer with a service to provide access to an online course with subsequent information support.

3.2. The Contractor provides the Service personally, without third parties' involvement.

3.3. Prior to the start of the course, the Customer provides the Contractor with the data necessary for registration on the Contractor's website following the form provided by the Contractor.

3.4. The Customer shall timely and independently familiarize themselves with the schedule of remote consultations posted on the Contractor's website at https://dramaticon.com/online.

3.5. The Customer undertakes to attend the online consultation course in person.

3.6. The start date of the provision of the Service is the organization by the Contractor of the first online session (consultation) for the Customer within the course framework, about which the Contractor notifies the Customer in advance by posting the relevant information on the Contractor's website.

3.7. The Contractor has the right not to start providing the Service, as well as to suspend the provision of the ongoing Service in cases of violation by the Customer of their obligations under this Agreement, namely: incomplete (improper, untimely) payment, provision of incomplete (unreliable) information, failure to provide (untimely submission) of registration or other data necessary for the provision of the Service per the information posted at https://dramaticon.com/course.

3.8. The Parties have agreed that there is no need to sign the Acceptance Certificate for the Service provided. At the same time, if no written claims are made regarding the quality and volume of the Service provided within three calendar days from the date of the actual end of the service, the service provided is considered to be accepted by the Customer in terms of quality and volume, which is equated by the Parties to this Agreement to the signing of the Act of Acceptance and Transfer of the Service provided.

4. Cost and payment procedure for the Service provided

4.1. The Contractor determines the cost of the Service provided and agrees with the Customer by issuing an invoice.

4.2. The Service provided under this Agreement shall be paid for by prepayment of 100% (one hundred percent) within one calendar day from the date of acceptance of this offer, but no later than the deadline established by the Contractor for accepting applications. Information about the deadline for receiving applications for the Service shall be posted by the Contractor at https://dramaticon.com/course or agreed with the Customer according to an individual plan.

4.3. Payment for the Service under this Agreement is made by bank transfer. In this case, payment is made when funds are received in the Contractor's current account.

4.4. Payment for the Service by third parties is not allowed.

5. Guarantees of the Contractor

5.1. In case of payment for the Service, under clause 4.4 of the Agreement, the Customer has the right to demand from the Contractor a refund of the paid funds without giving reasons within seven calendar days from the date of the start of the provision of the service specified in clause 3.7 of the Agreement, provided that the relevant Application is sent to the Contractor in writing.

5.2. The Customer has the right to demand a refund of the cost of the Service paid by him if the service was not actually provided within 180 (one hundred eighty) days from the date of its payment through the Contractor's fault. The amount determined by the Contractor for the Services not actually provided to the Customer is subject to refund. The cost of the Service is subject to refund, less the costs of the services of the bank servicing this operation.

5.3 In all other cases, except as provided for in this Agreement, the cost of the Service paid by the Customer shall not be refunded.

6. Dispute Resolution Procedure

6.1. The Contractor's claims regarding the Service provided shall be accepted by the Contractor for consideration by e-mail within 2 days from the date of the claim.

6.2. The party that received the claim is obliged to respond to it within ten working days from the date of receipt.

6.3. Claims sent to the Contractor are considered within the framework of the Republic of Kazakhstan's current legislation.

6.4. The pre-trial dispute resolution procedure is binding on the Parties.

6.5. If the dispute is settled in court, it shall be transferred for consideration to the Arbitration Court at the Contractor's location.

7. Conclusion, amendment, termination of this Agreement

7.1. The moment of conclusion of this Agreement is the moment of crediting the Contractor's account for the Service selected by the Customer, provided that the Application for participation in the course is received from them via electronic communication channels through the form posted at https://dramaticon.com/course.

7.2. The Contractor reserves the right to change or supplement any terms of this Offer Agreement at any time by publishing all changes on their website. If the published changes are unacceptable to the Customer, the Customer must notify the Contractor in writing within 7 (seven) days of publication.

7.3. The Parties have the right to terminate the Agreement by mutual consent at any time before its actual termination.

8. Final provisions

8.1. The Customer agrees to the processing and storage by the Contractor of the Customer's data contained in the Application (last name, first name, patronymic, age, email address, postal address, phone number).

8.2. The information transmitted and/or sent to the Customer as part of the Service provided by the Contractor is intended only for the Client, is confidential and protected by the provisions of the current copyright legislation and cannot be transferred to third parties, replicated, distributed, sent, published in electronic, paper or other form without additional agreements or the official written consent of the Contractor.

8.3. The Parties shall equate electronic document exchange between the e-mail addresses specified by the Contractor in this Agreement and the e-mail address selected by the Customer in the Application to paper document exchange, including when sending claims and/or responses to claims.

8.4. On all issues not regulated by this Agreement, the parties shall be guided by the current legislation of the Republic of Kazakhstan. In the event of any inconsistency or conflict between the English language version of this Agreement and the Russian translation of same, the Russian language version of this Agreement shall control.
